These GoldLink Interface Terms of Service (these “Terms”) govern your access to and use of the GoldLink website available at https://goldlink.io (the “Website”) and GoldLink Application (app) accessible at https://app.goldlink.io (the “Application”, and collectively with the Website, the “Platform”).

By accessing or using the Platform, connecting your Digital Wallet (as defined below) to the Application, or by clicking the button “I accept” or respective check box in connection with or relating to these Terms, you (“you”, “your”) acknowledge that you have read, accept without modifications and agree to be bound by these Terms and all terms incorporated herein by reference, which form a legally binding agreement between you and us. If you do not accept or agree to these Terms, you are not allowed to access or use the Platform and must immediately discontinue any use thereof.

If you are acting for or on behalf of an entity, you hereby represent and warrant that you are authorized to accept these Terms and enter into a binding agreement with us on such entity’s behalf, and you accept these Terms both on behalf of such entity and on your own behalf.Please read these Terms carefully, as they affect your obligations and legal rights.

1. Eligibility
To access and use the Platform, you must:

Be able to form a legally binding agreement.
Be at least 18 years old or the age of majority in your jurisdiction.
Not be a Prohibited Person or use the Platform for the benefit of a Prohibited Person.

2. Disclaimers and Acknowledgements
We do not provide custodial services or act as your agent. We are not responsible for any transactions you make, and we do not control or influence these transactions. Digital Assets are highly volatile, and their value can change dramatically. We do not provide financial, legal, regulatory, or tax advice. Always conduct your own research and consult professional advisors before making decisions. The distribution, possession and return of Digital Assets are solely between users to a transaction, and unless agreed to by us in writing, we are not an intermediary or a party to any transaction, and we do not provide any service to any user in connection with such transaction other than as described in these terms/in the Platform.

3. Warranties and Representations
You represent and warrant that:

You understand Digital Assets, Digital Wallets, blockchain technology, and related concepts.
You use the Platform only for business purposes.
Your Digital Wallet and Digital Assets are lawfully acquired.
You are not subject to sanctions and comply with applicable laws.
You understand the risks involved in transactions with Digital Assets.
You will comply with all applicable law when entering into a transaction on the Platform, including obtaining all necessary licenses, permits, consents, or approvals from regulatory authorities necessary for you to enter into transactions on the Platform.
You will perform your obligations under each transaction in good faith, and agree that we have no obligation to ensure the performance by another user to a transaction.
You will assume all legal, economic, and financial risks associated with a transaction you enter into.
You will make sure all information provided for a transaction is complete, accurate, and up-to-date and will not induce another user to enter into a transaction for illegal or fraudulent purposes, including using deceptive, misleading, and untrue information.
You agree to be solely responsible for all fees and taxes (including reporting any income or tax to any applicable governmental authority) incurred in connection with your activities on the Platform.

4. Prohibited Use
You agree not to:

Disrupt or interfere with the Platform.
Post harmful or inappropriate content.
Use the Platform for illegal activities.
Circumvent security measures.
Engage in fraudulent activities.
Violate third-party rights.

5. Digital Wallet
You may connect your Digital Wallet through compatible third-party software wallets like MetaMask or TrustWallet. We are not responsible for, and do not endorse, these third-party wallets. You are solely responsible for securing your Digital Wallet and its credentials. Disconnect your Digital Wallet from the Platform at any time.

6. Third-Party Content
We are not responsible for Third-Party Content or Third-Party Services. Your use of or reliance on Third-Party Content is at your own risk.

7. User Generated Content
By providing User Generated Content, you grant us a non-exclusive, irrevocable, royalty-free, perpetual, worldwide license to use, copy, and distribute your content.

8. Updates and Availability
We may update the Platform without prior notice. The Platform may be unavailable or interrupted from time to time. We are not liable for any such disruptions.

9. License
We grant you a limited, non-transferable, revocable license to use the Platform. This license can be terminated if you violate these Terms or if we choose to discontinue the Platform.

10. Proprietary Rights
"GoldLink", "GoldLink Protocol", and related trademarks and design elements belong to us. Your use of the Platform does not give you any rights to our intellectual property.

11. Availability and Access
We do not guarantee the Platform will always be available. Access may be prevented or limited without notice. We may terminate or discontinue the Platform at our discretion.

12. Restriction of Access
We may restrict or suspend access to the Platform for users in certain jurisdictions or those who violate these Terms. We may use tools to enforce these restrictions.

13. No Advice
The information on the Platform does not constitute business, legal, financial, investment, or tax advice. Consult your own advisors and use the information at your own risk.

14. Limitation of Liability
To the maximum extent permitted by law, we are not liable for:

Issues with the Protocol, software, or blockchain networks.
Transactions made through the Platform.
Third-Party Content or Services.
Inaccuracies in information provided.
Conduct of third parties.
Damages from malware or hacker attacks.
Personal liability of our officers, directors, employees, consultants, and shareholders.
Violate third-party rights.
Aggregate liability exceeding $1,000.

15. Transactions
Blockchain transactions are irreversible and final. You are solely responsible for your transactions and their risks, including potential losses.

16. Waiver of Fiduciary Duties
We do not owe any fiduciary duties to you. Our obligations are limited to these Terms and the implied covenant of good faith and fair dealing as required by law.

17. No Warranties and Representation
The Platform is provided "as is" and "as available." We disclaim all warranties, including implied warranties of title, non-infringement, integration, merchantability, and fitness for a particular purpose. We do not warrant that:

The Platform will work as expected, be secure, error-free, or available at any particular time or place.
Your use of the Platform will meet your expectations.
The information provided is accurate, reliable, complete, or correct.
Defects will be corrected.
The Platform is free of viruses or other harmful components.

18. Digital Asset Risk Disclosure
You acknowledge and agree that:

Digital Assets are still an experimental technology that is evolving and may change at any time;there is no assurance that a person who accepts a Digital Asset as payment today will continue to do so in the future;
Acquiring, trading, and exchanging real or Digital Assets involves significant risk. Prices can and do fluctuate on any given day. Due to such price fluctuations, you may gain or lose value in your Digital Assets at any given moment.
There is an inherent risk that losses will occur as a result of acquiring, holding, buying, selling or exchanging any Digital Asset, and the risk of loss in acquiring, trading or holding Digital Assets can be substantial and can result in the loss of your entire holding;
A user may not perform their obligations to a transaction, and legal remedies may be limited;
The collateral underlying a Digital Asset transaction may not have sufficient value to cover any loss you may incur in a transaction;
Digital Assets that are pegged to the price or value of any other asset, including fiat currency, are not guaranteed to remain pegged to that asset’s or fiat currency’s value;
Using Digital Assets and the Platform may carry legislative or regulatory risk which may adversely affect the transactions or the use, transfer, exchange, and value of the Digital Assets and may lead to the suspension or termination of your account due to legal or regulatory reasons;
Transactions in Digital Assets are generally irreversible, and, accordingly, losses due to fraudulent or accidental transactions may not be recoverable;
Some Digital Asset transactions will be deemed to be made when recorded on a public ledger, which is not necessarily the date or time that you initiate the transaction;
The nature of Digital Assets may lead to an increased risk of fraud or cyber attack; andThe loss, theft or destruction of a private key to access your Digital Assets may result in an irreversible loss.
